The Arizona Supreme Court unanimously ruled that an incremental rate increase by Arizona Water Company is legal even though the Arizona Corporation Commission did not hold a full hearing.
The commission had approved system improvement benefits that allowed the company to increase rates so long as they cover infrastructure improvements, the justices wrote.
The court said implementing such incremental increases without holding a full hearing does not violate the state constitution.
